These Terms of Service (“Terms”) govern your use of any services provided by HostByte Ltd (“HostByte”, “we”, “us”, or “our”), a UK-registered hosting provider. By registering an account or using our services in any way, you agree to comply with these Terms. If you do not agree, you must discontinue use of our services.
HostByte offers various digital hosting solutions including Game Hosting, VPS Hosting, Dedicated Servers, and Web Hosting (“Services”). These services allow you to launch and manage your own hosted applications and environments through our platform and infrastructure.
2.1 You must provide accurate and current information when registering. You are responsible for keeping your login credentials secure and for all actions taken through your account.
2.2 Any suspicion of unauthorised access should be reported to us immediately at [email protected].
3.1 All services are billed upfront unless explicitly stated otherwise. Charges are based on the package or configuration you select during checkout or upgrade.
3.2 All charges are non-refundable, except where required by UK consumer protection law.
3.3 Subscriptions renew automatically at the end of each billing cycle unless you cancel beforehand via our client portal: https://hostbyte.net/billing.
3.4 Pricing and plan specifications may be updated from time to time. Any changes will apply on your next renewal date.
3.5 One-month free trials are available for most server types. These are offered once per customer. You are responsible for cancelling the trial before it renews into a paid plan. Failure to cancel will result in standard billing.
4.1 You must not use our Services for activities that are illegal, harmful, or disruptive, including but not limited to:
4.2 HostByte reserves the right to suspend or terminate any account engaging in such activities, without notice or refund.
5.1 Services typically include clearly defined resource limits. Unmetered services may apply soft usage caps, depending on the game or workload. These are reviewed on a case-by-case basis.
5.2 If your usage impacts system stability, we may throttle, limit, or suspend service access at our discretion.
6.1 We strive for high availability but cannot guarantee 100% uptime. Planned maintenance, hardware failures, or external factors may cause temporary outages.
6.2 If your service is offline for a full calendar day, we’ll issue service credits upon request equal to one day of the affected service’s cost. These credits are applied to future invoices and are not redeemable for cash.
7.1 We do not guarantee the integrity of your data. It is your responsibility to maintain your own backups regularly.
7.2 HostByte will not be held liable for data loss resulting from service outages, system failures, account termination, or client error.
8.1 HostByte operates an affiliate programme with variable commission rates and a minimum withdrawal threshold. These details are visible in your client area.
8.2 Payouts are permitted once the minimum balance is reached. Referral commissions are granted for paying users only. Terms may vary by user and may be changed at our discretion.
We take abuse reports seriously and aim to respond to all reports within 2 working days. Abuse reports may lead to service suspension or termination following investigation.
All intellectual property, software, and branding associated with our Services are the property of HostByte or its licensors. You may not use, copy, or modify any materials without express written permission.
HostByte processes all user data in compliance with the UK GDPR and the Data Protection Act 2018. You can review how we collect, use, and protect data by visiting our Privacy Policy.
To the fullest extent permitted by law, HostByte shall not be liable for indirect or incidental losses such as loss of income, revenue, business, or data. Our total liability under these Terms shall not exceed the amount you paid for the relevant service in the 3 months prior to the issue.
You agree to indemnify and hold harmless HostByte and its staff against any claims or legal actions arising from your use of the Services or your breach of these Terms.
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
If any section of these Terms is found to be invalid or unenforceable, the remainder shall continue to apply in full.
We may revise these Terms at any time. The latest version will always be published on our website. Continued use of the Services means you accept the updated Terms.
